1. ACCEPTANCE OF TERMS

By creating an account and using Wonder Color Me Fun ("Platform," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. WHO CAN USE THIS PLATFORM

The Platform is intended for children ages 0-8 and their parents/guardians.

ONLY a parent or legal guardian can create and manage an account. By creating an account, you represent that you have the legal authority to do so and consent to your child's use of the Platform.

You are responsible for all activity on your account, including your child's use of the Platform.

3. ACCOUNT RESPONSIBILITIES

Parent/Guardian Obligations:

You are fully responsible for maintaining the confidentiality of your account login information.

You are responsible for all activity that occurs under your account.

You must immediately notify us of any unauthorized access or misuse.

You agree to monitor your child's use and ensure compliance with this agreement and applicable laws.

Account Misuse: If we determine that an account is being misused (including but not limited to unauthorized access, attempts to bypass parental controls, or other violations of these Terms), we reserve the right to:

Suspend or terminate the account immediately

Delete all associated data

Refuse service to the parent/guardian in the future

4. SUBSCRIPTION & PAYMENT TERMS

Subscriptions renew automatically on the date specified in your account.

You authorize us to charge the payment method on file each billing cycle.

You may cancel your subscription at any time through your account settings or by contacting us.

WE DO NOT OFFER REFUNDS. Cancellation takes effect at the end of your current billing cycle.

5. DELETION UPON CANCELLATION OR MISUSE

When your subscription ends or your account is terminated due to misuse:

We will delete all personal information associated with your account within 14 days.

We will delete all content uploaded by or attributed to your child's account.

This deletion is permanent and cannot be reversed.

6. LIMITATION OF LIABILITY

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.

To the fullest extent permitted by law, we are not liable for:

Interruptions or errors in the Platform

Loss of access to educational content

Any indirect, incidental, or consequential damages

Any harm to your child resulting from use of the Platform

You assume full responsibility and liability for your child's use of the Platform. We strongly recommend that parents/guardians monitor their child's activities and ensure the Platform is used as intended, as a supplemental educational tool only.

7. EDUCATIONAL CONTENT DISCLAIMER

The Platform provides interactive educational content for children ages 0-8. This content is NOT a substitute for professional medical advice, professional mental health care, or instruction from a qualified teacher. If you have concerns about your child's development, learning, or behavior, please consult with a healthcare provider or educational professional.

8. THIRD-PARTY LINKS & CONTENT

The Platform may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of third-party sites. Review their terms and privacy policies before allowing your child to access them.

9. ACCEPTABLE USE POLICY

You agree that you and your child will not:

Post, upload, or share hate speech, harassment, or discriminatory content

Attempt to engage in commercial spam or advertising

Attempt to bypass parental controls or access restricted features

Share personal information with other users

Use the Platform for any illegal purpose

10. INTELLECTUAL PROPERTY

All content on the Platform, including text, graphics, videos, and interactive lessons, is owned by Wonder Color Me Fun LLC or licensed to us. You may not copy, reproduce, or distribute this content without permission.

11. DISPUTE RESOLUTION

Any disputes arising from these Terms will be resolved through binding arbitration. Both parties agree to attempt informal resolution first by contacting wondercolormefun@gmail.com.

The arbitration will be conducted in accordance with the rules of the American Arbitration Association (AAA). The arbitration will take place in New York, New York. Each party will bear its own costs and attorneys' fees, unless the arbitrator awards fees to the prevailing party.

12. CHANGES TO TERMS

We may update these Terms from time to time. We will notify you of material changes via email. Your continued use of the Platform constitutes acceptance of the updated Terms.

13. SEVERABILITY

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect.
